Acceptance of Terms

Welcome to CutoutPhoto! By accessing or using our image processing services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our service.

These terms apply to all users of the service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

Important: By using CutoutPhoto, you represent that you are at least 18 years old or have parental consent to use the service. We reserve the right to refuse service to anyone for any reason at any time.

Service Description & Usage

CutoutPhoto provides AI-powered image processing tools including background removal, image enhancement, colorization, and other related services.

2.1 What We Provide

Our service allows you to upload images and apply various AI-powered processing tools to enhance, modify, or transform them. The processed images are made available for download for a limited time.

✓ Included: Background removal, AI enhancement, colorization, style transfer, upscaling, object removal, and other image editing tools.

2.2 Acceptable Use Policy

You agree to use our service only for lawful purposes and in accordance with these Terms. You are prohibited from:

✗ Uploading images that violate any copyright, trademark, or other intellectual property rights
✗ Uploading illegal, harmful, threatening, abusive, or obscene content
✗ Using the service to create deepfakes or misleading content for malicious purposes
✗ Attempting to circumvent any security features or usage limits
✗ Using automated tools or scripts to access the service without authorization
✗ Reverse engineering, decompiling, or attempting to extract the source code

2.3 Usage Limits

We may impose limits on the number of images you can process, file sizes, processing time, and other aspects of the service. These limits may vary based on your account type and are subject to change.

Excessive or abusive use of the service may result in temporary or permanent suspension of your access without notice.

Content & Intellectual Property

3.1 Your Content Ownership

You retain all ownership rights to the images you upload to our service. We do not claim any ownership over your original content or the processed results.

Content License

By uploading content, you grant CutoutPhoto a limited, non-exclusive, royalty-free license to use, process, and display your images solely for the purpose of providing the service. This license terminates when your images are deleted from our servers.

3.2 Our Intellectual Property

The CutoutPhoto service, including its software, algorithms, design, trademarks, and all related intellectual property, is owned by CutoutPhoto and protected by copyright, trademark, and other laws.

You may not copy, modify, distribute, sell, or lease any part of our service or software, nor may you reverse engineer or attempt to extract the source code of our service.

3.3 Data Retention & Deletion

Uploaded images and processed results are stored temporarily on our servers to enable the service. Images are automatically deleted after a specified retention period (typically 24-48 hours).

Important Notice

It is your responsibility to download and save processed images before they are automatically deleted. We are not responsible for any loss of data after the retention period.

Disclaimers & Limitations

4.1 Service "As Is"

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the service will be uninterrupted, secure, or error-free, or that the results will meet your expectations. Processing quality may vary depending on image characteristics and service load.

4.2 Limitation of Liability

Legal Disclaimer

In no event shall CutoutPhoto, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use or inability to use the service.

Our total liability to you for all claims arising from or relating to the service shall not exceed the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.

4.3 Indemnification

You agree to defend, indemnify, and hold harmless CutoutPhoto and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

Changes & Termination

5.1 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a new "Last updated" date.

Your continued use of the service after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the service.

5.2 Changes to Service

We may modify, suspend, or discontinue any aspect of the service at any time, including the availability of any features, database, or content. We may also impose limits on certain features or restrict access to parts or all of the service without notice or liability.

5.3 Termination

We may terminate or suspend your access to the service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
